Thinking about Armed Groups Legislating for Rights for their Detainees

Few governments want to face the problems associated with the thousands of persons detained by armed groups. War crimes law demands that armed groups should discipline their forces and in any process involving them or other detainees should apply ‘all the judicial guarantees which are recognized as indispensable by civilized peoples’. What does this mean in practice and what should we expect from armed groups in this context?

Andrew Clapham is Professor of International Law at the Graduate Institute Geneva, which he joined in 1997, an Honorary Member of the International Commission of Jurists, and an Associate Member of Matrix Chambers. He has been a member of the UN Commission on Human Rights in South Sudan since 2017. He was the Adviser on International Humanitarian Law to Sergio Vieira de Mello, Special Representative of the UN Secretary-General in Iraq. His current research focuses on the concept of war and he will publish a book with the title War in 2021.
