PhD project in Crimal Law which aims to contribute with a detailed research concerning how Swedish criminal law consent is constructed, what ideas it is based on and what problems there is with the legal construction as it is used today.

The PhD project Consent – ideology, dogmatics, critique investigates into consent as a legal institute in Swedish criminal law. Consent plays a significant role in contemporary criminal law, as well in our everyday life. Quite little work has been done on consent in Swedish criminal law, and thus several questions crucial for the application of consent are unclear. Among these are, e.g., whether the conditions for valid consent are the same in every context, what circumstances should be considered when assessing if a consensual act is justifiable, and how old a person must be in order to consent.

The project has three main aims: exploring what normative-ethical reasons justify granting consent relevance in the evaluation of interpersonal behavior; clarifying the rules around consent in contemporary valid law; and critically discuss which aspects of the valid law that face challenges – both from an internal, legal, perspective and from an external, structural, perspective.
