Approach to ”digital sequence information”

Page 34: “The Agreement does not define the concept of digital sequence information. This is because it has proved difficult to reach international agreement on what information should be covered by benefit sharing. However, ensuring that the legislation is clear and predictable requires that it is evident which information that is subject to obligations. Under the Inquiry’s proposal, the Swedish provisions on digital sequence information will apply to digital information on DNA and RNA sequences.”

There are risks associated with Sweden intending to define "digital sequence information" in its own legislation before all countries have agreed on its meaning. This could cause confusion, especially since the first Conference of the Parties (COP) for the BBNJ Treaty will later decide how benefit sharing for this information should function. Different countries having different definitions may undermine the unity of the Treaty and complicate the establishment of clear, common rules.

In the Swedish full text (p 294) it however says that “Bestämmelserna om marina genetiska resurser syftar till att skapa en rimlig och rättvis fördelning av den nytta som uppstår vid användningen av marina genetiska resurser från havsområden utanför nationell jurisdiktion och digital sekvensinformation om sådana resurser. Avtalet innehåller ingen definition av begreppet digital sekvensinformation. Anledningen till det är att det inte finns någon internationellt överenskommen definition eller avgränsning av vad som ingår i begreppet. Enligt Naturvårdsverket ska digital sekvensinformation förstås som digital information om genetiska resursers biokemiska beståndsdelar, särskilt om strukturer som bildas av molekylkedjor. På verkets hemsida anges vidare att begreppet omfattar åtminstone digitala data om DNA- och RNA-sekvenser samt att det eventuellt även skulle kunna omfatta information om till exempel aminosyrasekvenser, molekylstrukturer, proteinuttryck och metabolitprofiler.”

So, it is not entirely clear which definition Sweden will ultimately follow. For example, would proteomic data derived from marine genetic material under the BBNJ framework qualify as DSI under Swedish law? Overall, this approach seems somewhat inconsistent given the provision in 8.1.7 (p. 299) - where traditional knowledge of indigenous peoples and local communities is acknowledged as not defined in the Agreement, but no attempt is made by Sweden to define it, unlike the approach taken for DSI.

Specifying exclusions

Page 295: “Regleringen av marina genetiska resurser ska inte gälla för fiske och fiskerelaterade aktiviteter, såvida inte fångsten används för dess genetiska resurser (artikel 10.2). Bestämmelserna ska inte heller gälla för militära aktiviteter (artikel 10.3).”

While an exclusion is specified for fisheries and fishery-related activities, expanding this to explicitly include mariculture activities could be considered as well. This may extend beyond fish species to also include seaweed farming, which is expected to become increasingly important in coming years.

It is also notable that according to marine biodiversity records in the Ocean Biodiversity Information Service (OBIS) - https://obis.org – almost all species found in ABNJ have also been recorded within national jurisdictions. For instance, a 2024 study found that of the 1,639 marine species that have been referenced in marine gene patents, 281 have been observed in ABNJ, but only 5 of these species have been exclusively found in ABNJ (https://www.nature.com/articles/s41893-024-01392-w)

A reference could be made here to the new (2024) WIPO Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge, and new disclosure of origin requirements for patent filings.
