Research project Legal responsibility for bullying and violations in working life

The purpose of the project is to shed light on how bullying in working life is handled within the framework of legal labour law trials.

There is currently no uniform regulation of bullying and violations in the workplace. Instead, the legal issues that arise are of various nature, and actualize several regulations that are intertwined with each other. The employer has a responsibility regulated by public law to work preventively against violations, but there is no civil law legislation that addresses this type of problem once it has arisen. However, the lack of regulation does not mean that the problems cease, but they still have to be dealt with in the labor law examination. Most often, it is done in the context of questions about redeployments, dismissals and dismissals. The purpose of the project is to shed light on how bullying in working life is handled within the framework of these trials. An overarching question is what consideration is given to the interests of the parties involved: the bullied's interest in the violations ending, the employer's financial interest and the interest of all involved employees in employment protection.
